1. The Service

WishlistMe allows users to:

• create and manage wishlists,
• share wishlists with others,
• participate in group gift collections,
• communicate with other users,
• share payment links for voluntary contributions.

The Service is operated by a sole proprietor (individual entrepreneur) and is available worldwide.

2. Eligibility

The Service is available to users of all ages.

If you are under the age of 18, you confirm that you have permission from a parent or legal guardian to use the Service.

Content intended for adult audiences is not permitted on the Service.

3. User Accounts

To access certain features, users must create an account.

You agree to:

• provide accurate and up-to-date information,
• keep your account credentials secure,
• be responsible for all activity conducted under your account.

You are responsible for any actions taken through your account.

4. User-Generated Content

Users may create, upload, and share content, including:

• wishlists and gift items,
• text messages and descriptions,
• profile information and avatars,
• images where permitted by the Service.

You retain ownership of your content.

By using the Service, you grant WishlistMe a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your content solely for the purpose of operating the Service.

5. Prohibited Content and Conduct

Users may not upload, share, or distribute content that:

• is sexually explicit, pornographic, or intended for adult audiences;
• involves or depicts minors in a sexual or suggestive manner;
• is illegal, fraudulent, or promotes unlawful activities;
• contains hate speech, violence, harassment, or threats;
• infringes intellectual property, privacy, or other rights of third parties;
• is misleading or used to solicit funds fraudulently.

Any such content may be removed without notice.

6. Responsibility for Content

Users are solely responsible for all content they upload, share, or transmit through the Service.

WishlistMe does not review user-generated content prior to publication and does not endorse any content posted by users.

Interactions between users occur at their own risk.

7. Reporting and Moderation

The Service provides mechanisms to report inappropriate or unlawful content or behavior.

Upon receiving a report, WishlistMe reserves the right to:

• review the reported content,
• remove or restrict access to content,
• suspend or terminate user accounts,

at its sole discretion and without prior notice.

8. Group Gift Collections and Payments

WishlistMe does not process or handle payments.

For group gift collections:

• users may voluntarily share payment links (e.g., PayPal, Revolut);
• payment links are visible only to participants of the specific collection;
• payment links are stored in encrypted form.

All payments occur directly between users via third-party payment providers.

WishlistMe:

• does not hold funds,
• does not guarantee successful payments or gift delivery,
• is not responsible for disputes, refunds, or chargebacks.

9. No Guarantee of Gifts

WishlistMe does not guarantee that:

• a gift will be purchased,
• a collection will reach its target amount,
• any participant will make a contribution.

Participation is voluntary and at the user's own risk.

10. Affiliate Links

Some links available on the Service may be affiliate links. This means that we may earn a commission if you choose to make a purchase through such links, at no additional cost to you.

All purchases are made directly on third-party merchant websites. We do not sell products, process payments, control pricing, availability, shipping costs, or delivery times.

Any product information, including prices or availability, is provided for informational purposes only and may change without notice. The final terms of purchase are determined solely by the third-party merchant.

11. Intellectual Property

The Service, including its software, design, and branding, is owned by WishlistMe or its licensors.

Users may not copy, modify, distribute, or exploit any part of the Service without prior written consent.

12. Termination

Users may stop using the Service at any time.

WishlistMe may suspend or terminate access to the Service if:

• these Terms are violated,
• required by law,
• necessary to protect the Service or other users.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind.

WishlistMe makes no guarantees regarding:

• availability or reliability of the Service,
• accuracy of user content,
• outcomes of group gift collections.

14. Limitation of Liability

To the maximum extent permitted by law, WishlistMe shall not be liable for:

• indirect, incidental, or consequential damages;
• loss of funds resulting from third-party payments;
• disputes or interactions between users;
• user-generated content.

15. Indemnification

You agree to indemnify and hold WishlistMe harmless from any claims, losses, damages, or expenses arising from:

• your use of the Service,
• your content,
• your participation in group gift collections,
• your violation of these Terms or applicable laws.

16. Changes to the Terms

WishlistMe may update these Terms from time to time.

Updated Terms will be published within the Service and take effect upon publication.

Continued use of the Service constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany.
